Getting married to someone who owes back child support?

I am getting married to someone who owes back child support. My question is when we do get married will my tax return go to that person as well if we file as married? What are my options?Getting married to someone who owes back child support?

You could file Married Filing Separately. This would preserve your refund, however you may also pay higher total taxes that way.

There's a 3rd line of thought here though. He is going to be under the gun for the back child support until it's paid in full. That can run on for decades, even after the children are of age. That support money is going to come out of your household resources, one way or another. If you lose your portion of any refund to the child support, at least that money is ';Out of sight, out of mind,'; and will go to reduce the debt.
It will unless you file the injured spouse form with your return. That will allow you to file a married filing joint return. Your ONLY other option is to file married filing separate.

If you file joint return, your tax refund will be held. You can file Form 8379 (Injured Spouse).
If you file a joint return, the entire refund will be taken unless you file an injured spouse form. But if they just take the whole refund, his back support would be paid off faster.
You should think twice about him. If he wont support his own child do you think he'll support you and yes your tax return money will go to pay his back child support if his SSN# is own it.
My cousin went through this and yes her return and even her stimulus check went to his back child support.

Yes, it will go to the child. Do you really want to marry someone who won't support his own child for any reason?
If he dosen't support his kids, how do you expect him to provide for you?
i think you really need to look hard at the guy you are marring.
If you file ';married filing jointly'; any tax refund you're owed will be taken to pay for the back child support. Your alternative is to file ';married, filing separately.'; This option likely will result in your paying more taxes, though.





Also, you should be aware that if you and your husband live in a community property state, half of your income will belong to him and it could be garnished to pay his obligations. It happened to me!
My advice to you do not put down your married on your taxes. Your taxes will be very low you might not really get anything back. I prefer you to do single head of household. Let him do his own taxes that'ss his responsibility. I just got married on nov. 26 2008 my man owes irs do you think im putting married hell no because he is not messing up my money. I want everything every last dime. I work to hard to be paying back someone else stupidness. Please put single everyone know you getting married but youdon'tt have to put that your married on your taxes. Watch and see.That'ss my best advice i can give.
